Assumption of Risk and Waiver and Release of Liability Agreement
March 2025 Guatemala Tour

In exchange for my participation in the March 2025 Guatemala Tour and related events offered by Voyageur Tours (the “Trip”) in connection with Immigrant Advocates Response Collaborative, Inc. (“Immigrant ARC”), I hereby agree as follows: 

  1. Responsibility. I understand and acknowledge that Voyageur Tours is the sole tour operator for the Trip and is exclusively responsible for the planning and operation of the Trip, including but not limited to making any and all arrangements for transportation, accommodations, meals, activities, events, and selecting and engaging all third-party service providers. I understand and acknowledge that Immigrant ARC’s role in the Trip is limited to introducing potential Trip participants to Voyageur Tours and that Immigrant ARC has no responsibility for or control over the planning and operation of the Trip. 

  2. Assumption of Risk.  I recognize that my participation in the Trip presents certain inherent risks to my safety and health, as does participation in any trip that includes international travel, physical and recreational activities and transportation by aircraft, motor vehicle and/or other forms of transportation. I recognize and acknowledge that the potential inherent risks by participating in the Trip include but are not limited to loss of or damage to personal property, personal injury, economic loss, and/or death. I acknowledge that I have reviewed the Trip itinerary and other Trip materials provided by Voyageur Tours, that any questions I have had about activities or travel related to the Trip have been answered to my satisfaction, and that representatives of Voyageur Tours are available to answer any additional questions we may have. I recognize and understand the inherent risks involved in the Trip, and I voluntarily assume and accept all such risks.  

  3. Waiver and Release of Liability. I agree that Immigrant ARC is not responsible for the actions or omissions of Voyageur Tours or any other third-party entities providing goods or services in connection with the Trip. I, for myself and any of my spouse, partner, heirs, executors, and assigns, hereby agree to release and forever discharge Immigrant ARC, and its directors, officers, employees, representatives, agents, affiliates, and volunteers (collectively, the “Immigrant ARC Parties”), in their individual and/or corporate capacities, from any and all claims, liabilities, obligations, promises, agreements, disputes, and/or damages, that we may have or that we could each bring on our own, regarding any losses, damages, demands, or actions whatsoever that may arise out of the Trip. 

  4. Photo and Video. I agree that Immigrant ARC has permission to photograph and/or video me during the Trip and I hereby grant a perpetual and irrevocable non-exclusive, worldwide royalty-free right to Immigrant ARC: (a) to use, reproduce, publicly display, publicly perform and publish digital videos and photographs of me, including my image and likeness as depicted therein (the “Images”) ; (b) to use the Images in connection with marketing, promotional and instructional materials, including social media, to promote or otherwise inform or educate others about Immigrant ARC’s work; and/or (c) to use the Images for any other non-commercial purpose that furthers the charitable and educational mission of Immigrant ARC. I waive my right to inspect or approve finished versions of the Images, including written or spoken copy that may be created in connection therewith. I hereby release and hold the Immigrant ARC Parties and any Immigrant ARC licensees and assigns from any and all claims which I have or may have for invasion of privacy, right of publicity, defamation, copyright infringement, or any other causes of action arising out of the use, adaptation, reproduction, distribution, performance, broadcast, display, or exhibition of the Images.

  5. Severability. Should any provision or aspect of this Agreement be found unenforceable, all remaining provisions of the Agreement will remain in full force and effect. 

  6. Governing Law and Jurisdiction. This Agreement is governed by and construed in accordance with the laws of the State of New York. I agree to submit to the jurisdiction of the federal and state courts located in New York County, New York State for the resolution of disputes arising hereunder or relating hereto, regardless of the place of execution hereof.
