New York Habeas Program
Immigrant ARC, with support from the NY-NJ-PA Habeas Working Group and the NYU Law Immigrant Rights Clinic, launched a volunteer-based NY Habeas Program to file habeas petitions on behalf of non-citizen New Yorkers who have been arrested and detained by ICE.
Why Now: Every day, noncitizen members of our New York community are arrested by ICE. In this enforcement environment, often the only way to protect the rights of detained noncitizens is through the filing of a habeas corpus petition in federal court.
The NY Habeas Program leverages the broader legal community's expertise to help address this rising need.
How It Works: This volunteer program matches immigration attorneys with volunteer federal litigators and expert habeas mentors to fully litigate habeas petitions on behalf of detained New Yorkers. Each team’s dedicated mentor provides technical support and review. Teams are also supported by additional volunteers who can help with drafting, research, interpretation, or expertise in immigration law. Our program provides training and templates.
